By commissioning me in any kind of way, you are agreeing to the terms of service below.

Any statement can be bound to change if discussed with me, the artist, prior to the commission.

Please write in a clear and nice manner.

If possible, provide picture References

If there is no picture references (Character Designing Commissions) an additional fee will be added depending on character complexity. (Low Complexity: $10, higher complexity will be $15 or more)

Any ill behavior will not be tolerated, and your commission will be canceled if it occurs.

If you fail to follow the rules provided, I have the right to decline your commission or cancel at any time.

  1. All commissions must paid in FULL before starting

  2. The currency accepted is USD. If wanting to use Deviantart points: State at the beginning of the Commission message. We will discuss if this can be accepted at the time.

  3. Payments accepted through Paypal, Venmo, and Cashapp.

  1. If a Character Design Commission: A Design period will be provided.

    1. This contains a discussion time before the final illustration is started where I will provide crude, raw sketches of the character to get the features correct. Therefore the extra charge is added based on complexity. (See General Terms). This is not provided for other commissions.

    2. These sketches will be very low effort to just get the features and character in the correct direction. They cannot be used for personal or commercial use; it will only be between Client and Artist.

    3. If I provide sketches and begin to feel that I cannot provide the service correctly a refund will be issued (See Refunds)

  2. Work in Progress for normal (Non Design Commissions) will only be given in specific commissions.

    1. If the commission is $100 or more

    2. If the commission is for an Emote for streaming services.

    3. If artist needs further direction.

  3. The time for your commission will vary, it can be up to 3 months depending on many factors such as.

Health, order of commission, complexity.

A timeframe will be provided during intial commission discussion.  I do not provide daily or weekly updates, as this slows down workflow. If the initial commission timeframe is made to change an update will be provided. If any of the things stated above occurs you will be notified asap.

I will do everything I can to make my customers happy.

However after a commission is finished, only small changes are allowed to be made.

Such as small colouring/marking mistakes.

Any great changes will come with an extra charge.

Such as an outfit change, outfit addition or subtraction, background change or anything that makes me have to redraw it completely.

If your reference was unclear to start with, then you are not allowed to do minor changes without a fee.

Make sure to be clear in your order what you aim for.

I, the artist, hold every right to the produced drawing, not the commissioner.

Therefore I´m allowed to use the copyrighted artwork to;

Promote myself with in any place or site.

Publish books with.

To display it anywhere to my liking.

Post it wherever I want.

The commissioner are allowed to;

Use the copyrighted artwork for personal use only unless agreed otherwise.

Print the art, and claim the right of their character(s) but not the drawing itself.

Use the art to promote themselves with proper credit given to the artist.

If you break the copyright infringement in any way, every right you had to the drawing will be retracted.

The following is considered Copyright infringement:

Reproducing/using the copyrighted artwork commercially. (Meaning making money of it in any way)

Taking Credit for the creation of the artwork.

Removing any watermarks/signatures.

altering the artwork without my, the artist´s, consent.

A Purchase of Commercial rights to the artwork can be discussed. We can discuss an “adopt” fee, a shared commercial use fee or full rights.

Ownership Discussions: (Only for Character Design Commissions)

“Adopt”: Artwork stays ownership of artist, but the character design and references can be used for commercial use discussed but nothing further you must be clear for the usage.

Example “I am planning on using this for a video game.” They may use it for that purpose but cannot create further merchandise with the use of the art. Flat fee per usage. Commissioner can pay the agreed amount to use for multiple purposes.

“Shared Commercial use”: Artwork stays ownership of artist, however Commissioner would like to use the image for multiple commercial uses but doesn’t want full commercial rights (may want more artwork made by artist, may be unsure if they’re going to make anything.). A percentage of sales will be provided to the artist. Example: “The character is for a video game, I would like to provide posters and shirts for promo.” Percentage will be discussed.

“Full Rights”: 300% fee of original commissioned price. This provides full commercial rights to the character artwork to be used. Only credit is due and no further payments.

With commercial rights you are allowed to make any sort of merch with the artwork.
Use it in books, covers, as Props, change it to your liking and promote your own brand with.
Credit is still required for usage of the artwork, even if altered or edited.

I have the right to cancel and refund the money for your commission at any time.

  1. Refunds will be given if:

    1. You paid and I have not started. (Must be within the first 2 weeks of ordering)

    2. [Character Design Commissions ONLY & ONLY AVAILABLE during the design period! If the artist has begun the final design/illustration no refund will be given. The additional design fee will not be refunded if I have provided ANY sketches.] We have tried multiple designs and either the commissioner or artist does not believe that the artist could provide the design service necessary.

  1. Cancellations

    1. After the artist started can be made but no refunds will be given.

    2. After the 2 weeks and the artist has not started. Half a refund will be provided.

      1. This is due to possible job/income losses that might have been rejected due to your commission

    3. If the commissioner cancels any artwork created is full ownership of the artist. I may post it, trash it or sell it.

You have no right to cancel or demand a refund from the artist under any circumstances after payments are received.

If money has not been sent yet the commissioner has the right to cancel the commission.

If you file a charge-back against me, your right to everything I have ever made for you will be retracted and I have the right to sell the copyrighted artwork to new buyers.

You will be forbidden to ever commission me, Tessa Newsome, ever again.

Your name will be publicly posted everywhere I want to for others to watch out for.

I also have every right to file a complaint and I have all the right to the money you have given me.

Any statement can be bound to change if discussed with me, the artist, prior to the commission.
